Terms and Conditions for Travellers

1. Preliminary

A2B Travel Tech Ltd (Company No. 17080120), registered in England and Wales, trading as AtoBeach, operates this online website. As a fully licensed IATA BSP Travel Agency we are bound to fully comply with conditions as set by IATA. Please note that as a Travel Agency we provide bookings to our customers on behalf of the airlines, hotels and other third parties. We will always endeavour to contract only with reputable partners. However, we are not the company providing the final service to our customers and as such cannot influence the service provider directly.

2. Contract Contents

The binding contract comes into existence as soon as the person making the booking presses the button "Confirm Booking". This constitutes a legally binding agreement between A2B Travel Tech Ltd and the person making the booking to provide a service or services with a third-party service provider. Enforcing/providing the service as booked is not the duty of A2B Travel Tech Ltd. By contractually agreeing to the booking, the person making the booking confirms that he/she is of legal age and legally entitled to enter into contracts.

For this booking, the person making the booking is bound to the booking for 72 hours. Within this timeframe, A2B Travel Tech Ltd will accept this booking or will enter into contact with the booking person. Acceptance of this booking will be confirmed by receipt of our company. With payment by credit card, the acceptance of the contract will be considered the charge to the credit cardholder/traveller/participant of his credit card account for payment or partial payment.

The booking will be considered finalised as soon as all travel documents have been remitted to the client. We inform you that with the booking confirmation you receive a full summary of services selected and prices by email.

3. Responsibilities

Responsibilities of A2B Travel Tech Ltd

The contractual responsibility of A2B Travel Tech Ltd is to efficiently provide the bookings of products and services as booked. The actual service as such is not the responsibility of A2B Travel Tech Ltd. A2B Travel Tech Ltd acts on account of and on behalf of the service provider. The prices and conditions are set in accordance as contractually agreed between A2B Travel Tech Ltd and the service providers.

For further information about the products and services and conditions offered by the service providers please feel free to check the booking conditions as mentioned on their websites as indicated.

In agreement with the Law (EG), Nr.2111/2005 of the European Parliament and Council of 14.12.2005, A2B Travel Tech Ltd informs the clients about the identity of the actual airline performing the service both at the time of booking and on the booking confirmation.

Responsibilities of the Client

a) Every booking made by the client on the AtoBeach website is construed to be an offer to contract a service with a third-party service provider as booked by the client.

b) The person making the booking must verify the booking confirmation/cash receipt/credit card receipt as to being correct and must inform A2B Travel Tech Ltd within 48 hours of any incorrect items. Notification of errors received too late, for example modifications, does not allow the client to withdraw from the contract.

c) Please contact us immediately when you as the traveller have not received your confirmations/documentation at least 5 days prior to departure. In this case, we will, if payment has been made, arrange for the documents to be available for you at the airport (additional cost may apply). Should you fail to inform us and you cannot proceed with your travel arrangements (due to missing documentation) then this will be considered as a cancellation requiring payment (reduced reimbursement of expenses, if any).

With airline tickets, we recommend the client to select the electronic ticket option since no responsibility will be taken by A2B Travel Tech Ltd in the case of delays in the mail or courier service, meaning that the full extra cost of possibly making new tickets will be the client's own responsibility.

4. Fulfilment

A2B Travel Tech Ltd provides the travel services on behalf of its clients through third-party contracts as follows:

Airline Tickets: All tickets are issued directly by A2B Travel Tech Ltd. We provide full service as related to online and offline airline ticket bookings, flight changes, cancellations, reroutings, award tickets and ticket upgrades. An exception is for low-cost carriers where the bookings will be made directly with the low-cost carrier. Here the airline is the provider and all changes, requests for refunds must be made directly with the airline.

5. Liability of A2B Travel Tech Ltd as an Agent

a) A2B Travel Tech Ltd makes the necessary efforts to ensure that the information provided on this website is correct. A2B Travel Tech Ltd does not guarantee that this information is without error. The publicised information of this website, software and services may contain inaccuracies or spelling mistakes. The information provided here is subject to frequent changes and updates.

b) All liability of A2B Travel Tech Ltd and/or its suppliers of this website are limited to gross negligence.

c) Details about the services provided or negotiated tourism offers are fully dependent on the information provided by the suppliers. These do not constitute a liability from A2B Travel Tech Ltd towards the client.

d) The liability of A2B Travel Tech Ltd for the services provided are limited to the efficient provision of the services in the framework of a cautious trader, not to the accuracy, completeness, correctness of the information and timeliness thereof and the provision of services by the third party.

6. Deviations and Changes

a) Deviations and changes from individual travel arrangements are only enforceable if after contract agreement.

b) Last minute changes of flight times, destination as well as the change of aircraft and airline companies are expressly allowed.

c) Changes and variations of travel offers are only subject to claims after an agreement was made, not against the organiser handling in good faith and these changes do not materially impact the overall package offered.

7. Rebookings and Cancellations

a) The possibility of rebooking, cancellation of a booking or name change, as well as the conditions and costs of passenger changes are only dealt with in accordance with the supplier's conditions and cannot be influenced by A2B Travel Tech Ltd.

b) For making the changes as mentioned under 7(a), A2B Travel Tech Ltd will charge a service fee. In case of changes with low-cost carriers, the changes must be made directly with the low-cost carrier. Costs for making the changes will be indicated by the low-cost carriers when making the bookings.

c) Regarding rebooking and cancellation fees — these are exclusively dictated by the third-party contracts with suppliers.

d) Information about cancellation fees and rebooking fees are available on the website where applicable (see point no. 4). Since a travel insurance is not automatically included in the packages, we strongly recommend you to include such insurance when booking a package.

8. Acts of God or Force Majeure

A2B Travel Tech Ltd will not be liable for this contract in case of the following. This includes demonstrations, war, inner unrest, airline hijackings, acts of terrorism, fire, flooding, loss of power, accidents, storm, strikes, work stoppages or other actions taken to interrupt the services of A2B Travel Tech Ltd or its suppliers.

9. Contract Termination by A2B Travel Tech Ltd or the Supplier

A2B Travel Tech Ltd and the supplier have the right to cancel the booking or parts of the booking, reservation in the following cases:

  • The client is not creditworthy
  • The client's credit card payments have been refused by the credit card companies
  • It is indicated that the person making the booking is not legally entitled to enter into a contract or not of legal age in the country of their permanent residence

10. Price and Changes of Services

a) Based on conditions beyond the control of A2B Travel Tech Ltd, price and conditions may be changed by the suppliers which will entitle A2B Travel Tech Ltd to an adjustment. For instance exchange fluctuations, fuel surcharges, insurance surcharges and airport taxes.

b) Changes of price and conditions are part of the general conditions of the suppliers. Should A2B Travel Tech Ltd be informed of such changes then the clients will be informed immediately of such changes.

11. Service Fees

Since low-cost carriers as well as a growing number of airlines do not provide travel agent commissions anymore, A2B Travel Tech Ltd, as well as other suppliers, will charge a service fee.

12. Passport, Visa, Customs and Health Regulations

Every passenger is responsible for ensuring that he/she is holding valid travel documents in order that the trip can proceed without fail. This includes visas for all destinations and health requirements.

13. Cancellation

A cancellation of the booked trip by the passenger is not permitted. A traveller cannot withdraw from the commitment engaged with A2B Travel Tech Ltd or a third party by the person him/herself or through a relative/partner. In case the passenger decides to cancel a trip, then there may be financial consequences. These will be clearly stated in the booking conditions. Financial compensation obtained by court order is expressly prohibited.

14. Applicable Law

Law will be applicable for persons who are of legal age, those living in Cyprus, or those who don't live permanently in Cyprus or persons who have selected the country of residence to be a foreign country, Cyprus will be the location where the court will rule for this agreement.

15. Changes in the General Conditions

A2B Travel Tech Ltd is entitled to change or add to the general conditions with regards to this website with effect on future bookings at all times without having to notify the traveller. On the website however the latest version of the general conditions will be stated before the changes are made and with regards to further use of the website, the person booking agrees to the possible changes in the conditions.

16. Salvatorian Clause

Should one of the existing preconditions be impractical or impossible to fulfil then this will not affect the overall validity of this contract.


Terms and Conditions for Travel Packages

Annex I

Standard information form for package travel contracts where the use of hyperlinks is possible.

The combination of travel services offered to you is a package within the meaning of Directive (EU) 2015/2302. Therefore, you will benefit from all EU rights applying to packages. A2B Travel Tech Ltd will be fully responsible for the proper performance of the package as a whole.

Additionally, as required by law, A2B Travel Tech Ltd has protection in place to refund your payments and, where transport is included in the package, to ensure your repatriation in the event that it becomes insolvent.

Key rights under Directive (EU) 2015/2302 as transposed into national law.

If you conclude a contract not later than 24 hours after receiving the confirmation of the booking from A2B Travel Tech Ltd, the travel services provided will constitute a package within the meaning of Directive (EU) 2015/2302. Therefore, you will benefit from all EU rights applying to packages. A2B Travel Tech Ltd will be fully responsible for the proper performance of the package as a whole.

Additionally, as required by law, A2B Travel Tech Ltd has protection in place to refund your payments and, where transport is included in the package, to ensure your repatriation in the event that it becomes insolvent.

Annex II

Standard information form where the trader facilitating an online linked travel arrangement is a carrier selling a return ticket.

If, after selecting and paying for one travel service, you book additional travel services for your trip or holiday via A2B Travel Tech Ltd, you will NOT benefit from rights applying to packages under Directive (EU) 2015/2302. Therefore, A2B Travel Tech Ltd will not be responsible for the proper performance of those additional travel services. In case of problems please contact the relevant service provider.

However, if you book any additional travel services during the same visit to the AtoBeach booking website, the travel services will become part of a linked travel arrangement. In that case A2B Travel Tech Ltd has, as required by EU law, protection in place to refund your payments to A2B Travel Tech Ltd for services not performed because of A2B Travel Tech Ltd's insolvency, and, where necessary, for your repatriation. Please note that this does not provide a refund in the event of the insolvency of the relevant service provider.

A2B Travel Tech Ltd has taken out insolvency protection with the Association of Cyprus Travel Agencies. Travellers may contact this entity or, where applicable, the competent authority if services are denied because of A2B Travel Tech Ltd's insolvency.

Note: This insolvency protection does not cover contracts with parties other than A2B Travel Tech Ltd, which can be performed despite A2B Travel Tech Ltd's insolvency.

Annex III

Standard information form where the trader facilitating an online linked travel arrangement is a trader other than a carrier selling a return ticket.

If, after selecting and paying for one travel service, you book additional travel services for your trip or holiday via A2B Travel Tech Ltd, you will NOT benefit from rights applying to packages under Directive (EU) 2015/2302. Therefore, A2B Travel Tech Ltd will not be responsible for the proper performance of the individual travel services. In case of problems please contact the relevant service provider.

However, if you book any additional travel services during the same visit to the AtoBeach booking website, the travel services will become part of a linked travel arrangement. In that case A2B Travel Tech Ltd has, as required by EU law, protection in place to refund your payments to A2B Travel Tech Ltd for services not performed because of A2B Travel Tech Ltd's insolvency. Please note that this does not provide a refund in the event of the insolvency of the relevant service provider.

A2B Travel Tech Ltd has taken out insolvency protection with the Association of Cyprus Travel Agencies. Travellers may contact this entity or, where applicable, the competent authority if services are denied because of A2B Travel Tech Ltd's insolvency.

Note: This insolvency protection does not cover contracts with parties other than A2B Travel Tech Ltd, which can be performed despite A2B Travel Tech Ltd's insolvency.

Annex IV

Standard information form where the trader facilitating an online linked travel arrangement is a carrier selling a return ticket (additional travel services booked via link).

If you book additional travel services for your trip or holiday via this link/these links, you will NOT benefit from rights applying to packages under Directive (EU) 2015/2302. Therefore, A2B Travel Tech Ltd will not be responsible for the proper performance of those additional travel services. In case of problems, please contact the relevant service provider.

However, if you book additional travel services via this link/these links not later than 24 hours after receiving the confirmation of the booking from A2B Travel Tech Ltd, those travel services will become part of a linked travel arrangement. In that case A2B Travel Tech Ltd has, as required by EU law, protection in place to refund your payments to A2B Travel Tech Ltd for services not performed because of A2B Travel Tech Ltd's insolvency, and, where necessary, for your repatriation. Please note that this does not provide a refund in the event of the insolvency of the relevant service provider.

A2B Travel Tech Ltd has taken out insolvency protection with the Association of Cyprus Travel Agencies. Travellers may contact this entity or, where applicable, the competent authority if services are denied because of A2B Travel Tech Ltd's insolvency.

Key Rights Under Directive (EU) 2015/2302

  • Travellers will receive all essential information about the package before concluding the package travel contract.
  • There is always at least one trader who is liable for the proper performance of all the travel services included in the contract.
  • Travellers are given an emergency telephone number or details of a contact point where they can get in touch with the organiser or the travel agent.
  • Travellers may transfer the package to another person, on reasonable notice and possibly subject to additional costs.
  • The price of the package may only be increased if specific costs rise (for instance, fuel prices) and if expressly provided for in the contract, and in any event not later than 20 days before the start of the package. If the price increase exceeds 8% of the price of the package, the traveller may terminate the contract.
  • If the organiser reserves the right to a price increase, the traveller has a right to a price reduction if there is a decrease in the relevant costs.
  • Travellers may terminate the contract without paying any termination fee and get a full refund of any payments if any of the essential elements of the package, other than the price, are changed significantly.
  • If before the start of the package the trader responsible for the package cancels the package, travellers are entitled to a refund and compensation where appropriate.
  • Travellers may terminate the contract without paying any termination fee before the start of the package in the event of exceptional circumstances, for instance if there are serious security problems at the destination which are likely to affect the package.
  • Additionally, travellers may at any time before the start of the package terminate the contract in return for an appropriate and justifiable termination fee.
  • If, after the start of the package, significant elements of the package cannot be provided as agreed, suitable alternative arrangements will have to be offered to the traveller at no extra cost.
  • Travellers may terminate the contract without paying any termination fee, where services are not performed in accordance with the contract and this substantially affects the performance of the package and the organiser fails to remedy the problem.
  • Travellers are also entitled to a price reduction and/or compensation for damages where the travel services are not performed or are improperly performed.
  • A2B Travel Tech Ltd has to provide assistance if the traveller is in difficulty.
  • If the organiser or, in some Member States, the retailer becomes insolvent, payments will be refunded. If the organiser or, where applicable, the retailer becomes insolvent after the start of the package and if transport is included in the package, repatriation of the travellers is secured.
  • A2B Travel Tech Ltd has taken out insolvency protection with the Association of Cyprus Travel Agencies. Travellers may contact this entity or, where applicable, the competent authority if services are denied because of A2B Travel Tech Ltd's insolvency.
